CT: Court challenge to NCLB dismissed

Judge dismisses Connecticut's challenge to education law

New York Times  April 30, 2008

A federal judge dismissed Connecticut's case challenging No Child Left Behind.  Connecticut claimed that the federal government had not provided enough funds to pay for the requirements of the law thereby violating the law's "unfunded mandates" provision.  The judge ruled that Connecticut had not presented evidence that the state spent its own funds to comply with the law.  Connecticut's attorney general said he would file an appeal.  Other similar legal challenges to NCLB have met with more success.  The federal government is asking the full United States Court of Appeals for the Sixth Circuit to rehear a case that successfully challenged  the unfunded mandates provision of NCLB.
